February 25 "What About Us?" Diversity and Inclusion Issues in Financial Wellness
The financial services industry is set up really well to help people with money. For a long time, this business has in large part been staffed by older white men. As such, women, BIPOC and people without money are generally left underserved. We see this in 401(k) plan participation rates, debt accumulation, and most importantly, levels of financial stress your employees are taking to work with them. The system is set up, especially at work, to encourage, and sometimes even “force” people to choose retirement as their #1 savings priority. Interestingly when surveyed, there is only one group that prioritizes retirement as their #1 savings priority – white men. We have a lot of interesting stats, and some solutions.

Out of work conduct, such as employee behavior at social events, personal relationships in the workplace and recreational use of drugs and/or alcohol by employees has always been a gray area for employers. Today, employers have the technological means, and occasionally the inclination, to find out what workers are doing when outside of the workplace. However, your right to monitor your employees' conduct off the job and to make decisions based on that conduct is limited. If your investigation or questions invade an employee's right to privacy, you might end up in court defending those actions.

Legal Update: Phillips Lytle LLP Alert for BNHRA Members: Labor & Employment
NYS Minimum Wage & Overtime-Exempt Salary Levels Will Increase For Employees Working Outside Of NYCity On Dec 31, 2020 (December 21, 2020)
The New York State minimum wage rates and minimum overtime-exempt salary levels for employees working outside of New York City will increase on December 31, 2020. New York State employers with employees working in the State and outside of New York City should review the changes and make the necessary adjustments to ensure they are in compliance with the new requirements when they become effective.
Minimum Wage Increases
New York State’s minimum hourly wage rates for non-fast-food workers outside of New York City will increase on December 31, 2020, as follows:
- Nassau, Suffolk and Westchester Counties: $13.00 to $14.00 per hour
- Remainder of the State outside of New York City: $11.80 to $12.50 per hour
The minimum hourly wage rate for fast-food workers outside of New York City will increase from $13.75 to $14.50 per hour on December 31, 2020.

Government Affairs Updates
SUPPORT for Patients and Communities Act
The SUPPORT for Patients and Communities Act (SUPPORT Act) was signed into law to address the U.S. opioid crisis and takes steps to augment and enhance the nationwide system for preventing and treating opioid addiction.
The SUPPORT Act makes changes to a variety of public health and law enforcement policies. Here’s an overview of some of the health care-related policy changes included in the law.
· Medicaid Institutions for Mental Diseases (IMD) Exclusion: Amends the IMD exclusion to allow state Medicaid programs to receive federal reimbursement for covering certain IMD services up to a total of 30 days annually.
· Telehealth: Expands coverage of telehealth services under Medicare for the treatment of substance use disorders and co-occurring mental health disorders beginning July 1, 2019. Also directs the Secretary of Health and Human Services (HHS) to issue guidance regarding federal reimbursement for telehealth services and treatment for substance use disorders under Medicaid.
