November 4  Lead With Laughs: How Humor Inspires A Creative And Engaged Workplace

We have been conditioned to believe that “work isn’t the time or place to laugh,” but studies have conclusively shown that this couldn’t be further from the truth. Organizations that have integrated humor into their workplace culture have seen increases in productivity, collaboration and communication, and the ability to adapt to the adversity of uncertainty, all while showing a reduction in workplace stress, and a boost in morale.

Legal Update: Phillips Lytle LLP Alert for BNHRA Members: Labor & Employment 

New York State Paid Time Off for Voting Law Update
(Oct, 2020)

With election day fast approaching, New York State employers should ensure that they are ready to comply with § 3-110 of the New York State Election Law ("Law").  For many years prior to 2019, § 3-110 provided that employees who were registered to vote were entitled to up to two hours of paid time off to vote either between the opening of the polls and the beginning of their shift, or between the end of their shift and the closing of the polls.  However, in 2019, § 3-110 was amended to essentially entitle employees to three hours of paid time off to vote, regardless of how much time they had to vote before their workday began or after it ended. 

After much lobbying, earlier this year, New York State reversed the 2019 amendment and returned to the prev-2019 version of the Law.

Government Affairs Updates

SUPPORT for Patients and Communities Act

The SUPPORT for Patients and Communities Act (SUPPORT Act) was signed into law to address the U.S. opioid crisis and takes steps to augment and enhance the nationwide system for preventing and treating opioid addiction.

The SUPPORT Act makes changes to a variety of public health and law enforcement policies. Here’s an overview of some of the health care-related policy changes included in the law.

· Medicaid Institutions for Mental Diseases (IMD) Exclusion: Amends the IMD exclusion to allow state Medicaid programs to receive federal reimbursement for covering certain IMD services up to a total of 30 days annually.
· Telehealth: Expands coverage of telehealth services under Medicare for the treatment of substance use disorders and co-occurring mental health disorders beginning July 1, 2019. Also directs the Secretary of Health and Human Services (HHS) to issue guidance regarding federal reimbursement for telehealth services and treatment for substance use disorders under Medicaid.
